Even though I gave my leasing agent all of the information Dominion Post Oak Proceeded with the eviction process.. Something they were not supposed to do because they agreed to the terms. Since the repair I have been able to sleep the whole night and began repairing the damage to my home and work life. The repair was after 17 days of pleading and begging you to fix the A/C. I dealt with serious sleep deprivation effects and I was a physical and emotional wreck for 17 days. My job and home life were impacted, and even had an emotional breakdown in front of your maintenance staff after 2 days of no sleep. I am subjected to sleep deprivation effects since the noise and vibration wakes me up every 40 minutes thru the night. I missed work and do not function well once I get there. My supervisor noticed my sluggish state and he ‘does not like it’. Job is at risk. In addition, there is increased friction with my family since my mood is very transient and chaotic over this past two weeks. The apartment management makes continuous excuses for the noise including stating over and over that it is from the building next to us. However, I spoke with them and their a/c does not run from 7PM to 6AM. Apparently, they did not properly investigate the noise since it would involve disturbing other renters. If they investigated properly with due diligence, they would have located the failing a/c. In Dec 2021, my a/c was repaired after it failed and made a lot of noise. I contacted the Houston Directors but the issue is yet to be resolved. I am out of ideas and desperate to have a normal sleep. I am hoping the BBB can exert some influence. A record of Service Requests, emails and phone calls (6pgs) is attached, and a sample of 2 Service Requests which were not adequately addressed. DOMINION POST OAK A/C FAILURES & 1806 RESIDENT NOTICES: To Rebecca Bond email & delivered in person to office – Oct. 6, 2022: This letter provides an update and summary to the malfunctioning, noisy condensing units near my apartment, No 1806 starting on September 25 to today. Dominion Post Oak Apartments seems to refuse to repair a neighbor’s noisy, failing air conditioner. It actually vibrates my bedroom wall. Impossible to sleep well for 14 days and counting. Blames buildings next to us, but that is incorrect since their A/Cs do not operate after 7pm. Many excuses, but in the meantime, I suffer every day at work and at home with relationships. I. Current Unit 1806 Air Conditioning Observations: • Background: Registered Professional Mechanical Engineer (PE) in Texas for 22 years. Expert in rotating equipment and HVAC systems. • Building and infrastructure is old and aging. The air conditioners are run hard and continuously during the hot summer. Understandably, the condensing units outside mounted in the walls will fail - fans, bearings, lubrication and compressors. These issues cause noise, vibration and eventually failures. • Four (4) times in the past, service requests were made for noisy, vibrating condenser units and were repaired successfully. My unit had noise and vibration in Dec 2021 and was successfully repaired. • On Sept 22, 2022, the noise and vibration from a neighboring condensing unit began. Several Service Requests were generated. Includes emails and phone calls. Refer to summary below. • Vibration only occurs when apartment 1906’s or 1706’s AC is on and only in the West side of the bedroom wall, same area where the unit is attached. The wall section east of the window does not vibrate. A/Cs are located above and below that area also. • My A/C unit does not make much nose and does not vibrate the West side of the bedroom wall. • Noise and vibration of bedroom wall requires use of ear plugs, sleeping pills and running my a/c continuously at night to provide low-level consistent noise to help drown out the noisy a/c. • Impacts: o Very poor sleep for 14 days, o Late for work several times since unable to function or missed alarm due to ear plugs. Super o Noticeable friction with wife and relationship. o Due to exhaustion picked up cold and flu illness on Oct 5. • Limited to no response by Dominion Post Oak staff. No successful actions taken. II. Parkway Towers Air Conditioning System Noise: • Your continuing insistence that the noise is from the office building’s air handling system next to us is quite incorrect and misleading. • I stated several times that I noticed that the air handling units at Parkway Towers did not run late in the evening and early mornings. • I cannot even hear Parkway Tower’s air conditioners from the 18th floor. • Yesterday I spoke with property manager, Hunter Drackett ). I informed them that Dominion Post Oak believes they were responsible for noise and vibrating my wall on the 18th Floor of Dominion. “No way” was his immediate response since their cooling system only runs from 6am to 7pm. He also stated that he has never received complaints from Dominion. This contradicts your statements that you have made complaints with them. • I spoke with Property One’s Chief Engineer, Nathan Roane. His response was “impossible”. III. A/C Manufacturer: • The AC units are from Johnstone Supply of Houston, . • I spoke with technician who stated for vibrations, the fan motor or fan itself is damaged. Bearings wear out ot the fan becomes unbalanced and needs to be replaced. • The cost of a new motor is around $175. IV. Current Actions Oct 6: • Prepare summary of issue, send to Monalisa. • Plan to meet with Houston Regional Director on Bering Steet. • If no progress with Director, will submit claim to Houston BBB. V. Remedies: • Dominion to locate & repair the noisy, unbalanced A/C unit by Tuesday Oct. 11, 2022. • Tim Smith hires council to help resolve issue and recover lost wages, rent payments during issue, etc. Tim Response to Dominion - 4Oct22 Monalisa, No profanity. There is no way the A/C from across the street can vibrate only the left side of my bedroom wall while the right side of the window wall does not vibrate! I cannot take another night of no sleep. It is very unfair especially after you say you are a luxury apartment, but do not attend to your aging infrastructure. “If you are looking for a well infested apartments with an old wooden floor of over 10 years then this is the right place for you. Not one day that i slept in that apartment that i do not see roaches and insects. The old wooden floor didn’t hit me until i moved in, super old wooden floors and paying $2400 a month and they still can’t change the old floors . Do not let the views get you, pay attention to the wooden floor, very old kitchen cabinets, damaged sinks , very old that you are bound to continue living with ants and insects every day. I had to move out after feeling unsafe when the manager illegally went through my apartment during a work order, came in and went through my apartment and my belongings while i wasn’t present to tell me i am using my apartment for a short let’s after only a week of moving in . This is very unsafe , if they can illegally come into your apartment and search in while you aren’t there , i will not advice anyone to stay here. Do not get carried away with the views. The wooden floors is disgustingly old, and the cabinets, and if you put in a work order, be expecting the maintenance to call the manager to come in and search your apartment as this is what they do. A lot of the people that live here seem like they like to party. My balcony is always trashed from the ppl who live above me. The 7th floor is noisy from all of the foot traffic with ppl going to the gym, pool, and pet area. They never close that area after 10pm. I had issues with my unit after moving in. The hardwood flooring was all scratched up and one of the managers tried to say it was distressed hardwood. Lol then had the nerve to tell me you dont have to live there after Id paid movers to move all of my things. How professional! The carpet was old and she tried to say they replaced that as well. It was all lies! After talking with the manager and another leasing agent they got them both taken care of. Now I have an issue with an old dishwasher they have in here thats reeking of a poop smell. They have yet to replace it and have been telling me to let it run with Clorox. Why not replace it instead of having me waste energy and water! The first person that I met 3 years ago when my sister and I came to look at apartments was Mona Lisa . We had looked at 2 other apartments and the main reason why we decided to lease with Dominion Post Oak was how the staff treated us , and how Mona Lisa was always so responsive to our questions - our situation was a little complicated but Mona Lisa got the lease done and approved and moved us in ASAP. The building is on great shape, I am on the 11th floor and our view is amazing. Whenever we needed a helping hand, the maintenance staff was always there to help. Mona Lisa is by far one of the best leasing agents we have ever known , and we having been leasing for years at many different communities . Last but not least , Sharie the manager helped us out quite a few times , especially when we found a house and had to give notice that we were moving out . Sharie is super sweet and always here to help the tenants . I just read the review left by someone "anonymous" , and I will stand my ground 100% that it must be a fake review .
